Real estate title glossary
What is CC&Rs?
Also called: deed restrictions, restrictive covenants
Definition
CC&Rs are recorded rules that bind every owner in a subdivision or condominium, covering things like use, appearance and HOA assessments.
They run with the land, so later owners are bound without signing them. The HOA's power to lien a home for unpaid dues usually comes from the CC&Rs.
How it shows up in a title search
Declarations and amendments are recorded in the land records; a search lists them as encumbrances on the lots they cover.
