Terms of Service

These terms apply when you use heritagedeed.com or buy a report from us. Please read them, especially the sections on what a report is and is not, permitted use, and limits of liability. By placing an order you agree to them.
1. Who we are
HeritageDeed (“HeritageDeed”, “we”, “us”) is operated by HeritageDeed. You can reach us at support@heritagedeed.com.
2. What we provide
HeritageDeed runs automated searches of official public records for a property you specify and compiles the results into a report (a PDF plus the same data in JSON). Depending on the report type and location, a report can include recorded deeds, mortgages and satisfactions, recorded liens, UCC filings, court records matched to owner names, property tax and assessment data, building violations, flood-zone and environmental data, and an AI-assisted summary.
We only accept orders for the areas listed on our website. Sources, fields and coverage differ by county and can change when a government office changes its systems.
3. What a report is not
A report is not title insurance, a title commitment, an abstract of title certified by a licensed abstractor, a legal opinion, or legal advice. HeritageDeed is not a title insurer, title agent, law firm or licensed abstractor, and no attorney–client or fiduciary relationship is created by your use of the service. A report reflects what the searched sources returned at the time it ran. Before you rely on anything in a report for a purchase, loan, closing or legal proceeding, have it confirmed by a licensed title professional or attorney against the official records.
4. Permitted use
You may use a report for lawful purposes connected with real property, such as due diligence before a purchase, loan or investment, and you may share it with your attorney, lender, title company, broker or other advisers.
You may not:
- use a report, or any information in it, as a factor in deciding a person’s eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose covered by the Fair Credit Reporting Act. HeritageDeed is not a consumer reporting agency and reports are not consumer reports;
- use the service to stalk, harass or harm anyone, or for any unlawful purpose;
- resell reports, or redistribute them in bulk or as part of a competing product;
- scrape the website, place automated orders, probe or interfere with our systems, or try to get around any limits or security measures.
We may refuse, cancel or refund an order, or suspend access, if we reasonably believe it breaches these terms.
5. Orders, prices and payment
Prices are shown on our website in US dollars. Sales tax or VAT is added at checkout where it applies. Payment is due when you order.
Our order process is conducted by our online reseller and merchant of record, Creem (Armitage Labs OÜ), which processes your payment, collects any applicable taxes and issues your receipt. Your purchase is also subject to Creem’s Buyer Terms. We do not receive or store your card details. Questions about the report itself go to us; questions about a charge can go to us or to Creem.
6. Delivery
After payment is confirmed the search starts automatically. When it finishes you can download the report from your order page, and we email you a link. Most reports are ready within minutes; a slow or unavailable government source can make it take longer. Keep your order link and email: they are how you access the report, and no account is created.
7. Refunds
Refunds are covered by our Refund Policy, which forms part of these terms. Nothing in these terms limits any right to a refund you have under applicable law.
8. Accuracy and limitations
- Public records can be incomplete, contain errors, or lag behind recent filings.
- Some documents are indexed only by name. Court and lien searches match names, so they can miss records filed under a variant name and can include records about a different person with the same or a similar name.
- A government source may be unavailable when your report runs. Each report lists the sources searched and whether they responded.
- The executive summary and risk score are generated with the help of an AI model from the data in the report. They can be wrong; the underlying records control.
- Mortgage amounts are original recorded amounts, not payoff balances.
9. Intellectual property
The website, its design and software, and the format and compilation of our reports belong to HeritageDeed. When you buy a report you get a personal, non-exclusive licence to use it as described in section 4. Underlying public-record information is not owned by us.
10. Disclaimer
Except as expressly stated in these terms, the service and reports are provided “as is” and “as available”, and to the fullest extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals or loss of property value, arising from the service or any report; and (b) our total liability for any claim relating to a report or the service is limited to the amount you paid for the report the claim relates to. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
You agree to indemnify us against claims, losses and costs arising from your use of a report in breach of section 4 or of applicable law.
13. Changes
We may update these terms. The version shown here, with its date, applies to orders placed while it is posted. We may also change or discontinue parts of the service; orders already paid will be fulfilled or refunded.
14. Contact and complaints
If something is wrong with an order, email support@heritagedeed.com with your order number. We reply within three business days and will try to resolve any dispute informally first.
