* Not shown: the list publishes no sale date. Individual former owners are shown as initials; business names as published. Where the list gives no street address, a row shows the parcel or case number only. Under Fla. Stat. 197.582, governmental liens and then other liens, by priority, are paid from the surplus before the former titleholder. A HeritageDeed title report lists the mortgages and liens recorded on the parcel: $49. Rows of $1,000 or more have the button. Amounts change as claims are paid: confirm with the office that holds the money.

How to claim surplus funds in Hillsborough County

Fla. Stat. 197.582: a claim must be filed with the Clerk within 120 days of the Clerk's mailed notice of surplus. Governmental liens are paid first, then other liens by priority, before the former titleholder. A lienholder who misses the 120 days is barred; the former owner's own claim is not, and money nobody claims is handled as unclaimed property for the titleholder (197.582(5) and (9)).

Claims are accepted by mail only, on the Clerk's 'TD-120 Day Surplus Proceeds Affidavit' (files sold from August 15, 2019) or 'TD-Excess Proceeds Affidavit' (earlier files); a titleholder adds a copy of government ID. The list shows only the file number and the amount; the Clerk's office has each file's sale date, parcel and former owner. Statute: Fla. Stat. 197.582.

HeritageDeed is not a surplus recovery company and does not file claims. Claims are filed with the clerk, court or state office named on each county page, whose instructions describe claimants filing for themselves; a lawyer is optional.

Liens are paid before the former owner

Whatever is recorded against the property (an unreleased mortgage, a judgment, a code enforcement or tax lien) can take part or all of the surplus before the former owner is paid.

A HeritageDeed title report for the address lists the deeds, mortgages matched to their releases and the liens of record, and names any surplus amount on this list for the same parcel. Use "Check liens on this property" on a row to start one with the address filled in.
