Published: the District Clerk's expected final disbursement date, about two years after the sale (Tex. Tax Code 34.03(a)(2)). Individual former owners are shown as initials; business names as published. Where the list gives no street address, a row shows the parcel or case number only. Under Tex. Tax Code 34.04, the court pays taxing units for later taxes and lienholders, by priority, before former owners. A HeritageDeed title report lists the mortgages and liens recorded on the parcel: $49. Rows of $1,000 or more have the button. Amounts change as claims are paid: confirm with the office that holds the money.

How to claim surplus funds in Ector County

Tex. Tax Code 34.04: a claimant files a petition in the court that ordered the tax sale, which may be filed under the tax suit's own cause number, before the second anniversary of the sale. The court pays taxing units for later taxes and lienholders by priority before former owners; money unclaimed after two years goes to the taxing units (34.03). An owner's claim may be assigned only on the terms of 34.04(f), including payment of at least 80% of the claim.

File a petition for the excess proceeds in the case number shown, in the Ector County court named on the list, and serve it on the parties to the tax suit at least 20 days before the hearing (34.04(b)). Statute: Tex. Tax Code 34.03 and 34.04.

HeritageDeed is not a surplus recovery company and does not file claims. Claims are filed with the clerk, court or state office named on each county page, whose instructions describe claimants filing for themselves; a lawyer is optional.

Liens are paid before the former owner

Whatever is recorded against the property (an unreleased mortgage, a judgment, a code enforcement or tax lien) can take part or all of the surplus before the former owner is paid.

A HeritageDeed title report for the address lists the deeds, mortgages matched to their releases and the liens of record, and names any surplus amount on this list for the same parcel. Use "Check liens on this property" on a row to start one with the address filled in.
