Questions
How is Florida documentary stamp tax on a deed calculated?
Divide the price by 100, round up to the next whole number, and multiply by $0.70. A $450,000 sale pays $3,150 in stamps on the deed. Miami-Dade County uses a different rate.
How much are doc stamps on a Florida mortgage?
35 cents per $100 of the amount borrowed, rounded up to the next $100, plus a one-time intangible tax of 2 mills (0.2%). A $360,000 mortgage pays $1,260 in stamps and $720 in intangible tax.
Who pays documentary stamp tax in Florida?
By custom the seller pays the stamps on the deed and the buyer, as borrower, pays the stamps and intangible tax on a new mortgage. The statute lets the state collect from either party, and the contract can assign it.
Is documentary stamp tax due on a quitclaim deed?
Yes when there is consideration, which includes the amount of any mortgage on the property the grantee takes on. A transfer with no consideration and no mortgage pays the minimum stamp.
