How recording works here

In South Carolina, deeds, mortgages and the satisfactions and releases of them are recorded with the county Register of Deeds. An unrecorded deed or mortgage is not valid against later creditors or purchasers for value without notice; the instrument counts only from the day and hour it is recorded (S.C. Code § 30-7-10).

A South Carolina mortgagee that has been paid in full must enter satisfaction of the mortgage within three months after the mortgagor or another interested person asks in writing by certified mail or another method with proof of delivery (S.C. Code § 29-3-310), so a mortgage with no recorded satisfaction is still of record.

The Horry County Register of Deeds' index links each mortgage to the satisfaction recorded for it: a document's detail page lists the related documents by book and page.

A judgment is a lien on a debtor's real estate in a county only once it is entered on that county's book of abstracts of judgments, and lasts ten years from the date of the judgment (S.C. Code § 15-35-810).

What it does not cover

Documents are tied to the property by parcel number, street address or lot, unit and subdivision; any tied only by the owner's name are marked, and a name that differs by suffix (Jr., III) or middle name is treated as another person.

Mortgages of earlier owners are not searched under the seller's name, and mortgages older than the purchase or ten years are not shown.

Judgments entered on the county's book of abstracts of judgments are not searched: the Register's document-type list has no judgment type.

The county parcel layer publishes no assessed or market values, and delinquent property taxes are not searched.

The report is a public-records search, not title insurance or an attorney's opinion of title.

How to search Myrtle Beach records yourself

  1. Find the parcel and the current owner at the Horry County Assessor. Note the parcel number and the owner's exact name.
  2. Search the Horry County Register of Deeds records search by parcel or by name for every deed, so you can see how the current owner took title and from whom.
  3. List every mortgage or deed of trust recorded against the parcel, then look for a matching satisfaction or release for each one. Anything without a release may still be open.
  4. Search the same names for liens, judgments and lis pendens, including state and federal court indexes, and check property tax status with the tax office.
  5. Write down document numbers and dates so a title company or attorney can pull the originals.

A HeritageDeed report runs those steps automatically and shows the source of every finding.

Questions about Myrtle Beach title searches

How does a Horry County search show whether a mortgage has been paid off?

The Horry County Register of Deeds' index records home loans as MORTGAGE documents. A mortgagee that has been paid must enter satisfaction within three months after a written request with proof of delivery (S.C. Code § 29-3-310), and the Register's index links each mortgage to the satisfaction recorded for it, so a mortgage with no linked satisfaction is still of record. Judgments are a lien only once entered on the county's book of abstracts of judgments (S.C. Code § 15-35-810), which this search does not read.
