How recording works here

In North Carolina, deeds and other real property documents are recorded by the county Register of Deeds. A recorded conveyance is effective against lien creditors and purchasers only from the time of its registration (G.S. 47-18), so the order of recording decides priority.

A North Carolina home loan is secured by a deed of trust. The lender must submit a satisfaction for recording within 30 days after payoff (G.S. 45-36.9), so a loan with no recorded satisfaction is still a lien of record.

The Durham County Register of Deeds' online index covers real estate documents from January 1, 1978; its own notice excludes the historical record and the mortgage, condominium, corporate and plat books.

Judgments are docketed with the Clerk of Superior Court, not with the Register of Deeds (G.S. 1-234).

What it does not cover

The index starts in 1978: a purchase before then has its deed read by book and page, but earlier loans are not searched.

Documents are tied to the property by parcel number, street address or lot and subdivision; any tied only by the owner's name are marked. A satisfaction that cites a loan's book and page is matched exactly; one that does not is matched by borrower and lender name.

Loans of earlier owners are not searched under the seller's name, loan amounts are not published, and delinquent property taxes are not searched.

Judgments docketed with the Clerk of Superior Court are not searched.

The report is a public-records search, not title insurance or an attorney's opinion of title.

How to search Durham County records yourself

  1. Find the parcel and the current owner at the Durham County Tax Administration. Note the parcel number and the owner's exact name.
  2. Search the Durham County Register of Deeds by parcel or by name for every deed, so you can see how the current owner took title and from whom.
  3. List every mortgage or deed of trust recorded against the parcel, then look for a matching satisfaction or release for each one. Anything without a release may still be open.
  4. Search the same names for liens, judgments and lis pendens, including state and federal court indexes, and check property tax status with the tax office.
  5. Write down document numbers and dates so a title company or attorney can pull the originals.

A HeritageDeed report runs those steps automatically and shows the source of every finding.
