In North Carolina, deeds and other real property documents are recorded by the county Register of Deeds. A recorded conveyance is effective against lien creditors and purchasers only from the time of its registration (G.S. 47-18), so the order of recording decides priority.

A North Carolina home loan is secured by a deed of trust. The lender must submit a satisfaction for recording within 30 days after payoff (G.S. 45-36.9), so a loan with no recorded satisfaction is still a lien of record.

The Forsyth County Register of Deeds says documents were not officially recorded in the county until 1913 (a few instruments date from 1849), that computerized indexes began in 1965, and that its online record search is hosted by a third-party vendor. The online index records the year only for documents before 1997.

The Register's site links a deed of trust and its satisfaction to each other in a cross-reference column, and the Register's own notice says UCC financing statements are not available on that site.

The Register's office says information about divorce decrees, estates, foreclosures, judgments, liens, wills and paternity is held by the Clerk of Superior Court; judgments are docketed there, not with the Register of Deeds (G.S. 1-234).

What it does not cover

The index is computerized from 1965 and shows only the year for documents before 1997; instruments before the index, and the Register's older books, are not searched.

The Register's index has no parcel number. Documents are tied to the property by its street address or by the lot and subdivision in their description; any tied only by the owner's name are marked.

Loans of earlier owners are not searched under the seller's name, loan amounts are not published, and delinquent property taxes are not searched.

Judgments, and the liens, estates and wills the Register says are kept by the Clerk of Superior Court, are not searched.

The report is a public-records search, not title insurance or an attorney's opinion of title.
